PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. By registering for or participating in any class, workshop, or event, renting or leasing space, and using facilities and equipment offered by Crescent City Clayworks LLC (“the Studio”), you acknowledge that you have read, understood, and agree to this Liability Waiver and Release of Claims. This agreement applies to all individuals included under a group registration.

1. Assumption of Risk

I understand that participation in ceramic arts, pottery, clay work, and similar artistic activities involves inherent risks, including but not limited to:
– use of tools, equipment, and machinery;
– exposure to sharp, heavy, hot, or otherwise hazardous materials;
– slipping hazards from water, clay, and studio conditions; and
– potential damage to personal property or projects left at the Studio.

I voluntarily assume all risks of injury, illness, damage, or loss associated with my participation.

2. Release of Liability

In consideration for being permitted to participate in activities at Crescent City Clayworks LLC, I hereby release, waive, and discharge the Studio and all of its owners, employees, instructors, contractors, agents, and representatives (“Releasees”) from any and all claims, demands, damages, injuries, losses, actions, or causes of action arising from or connected to my participation, whether caused by negligence or otherwise.

3. COVID-19 and Communicable Disease Notice

I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume all risks that I or my child(ren) may be exposed to or infected while attending or participating in Studio activities. I agree that Crescent City Clayworks LLC is not responsible for any resulting illness, injury, or loss.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Releasees from any loss, liability, damage, or cost arising from:
– my participation in Studio activities;
– my use of tools, materials, or equipment; or
– my violation of Studio rules or instructions.

5. Compliance With Studio Rules

I agree to follow all safety instructions, operational rules, and staff directions issued by Crescent City Clayworks LLC. Failure to comply may result in removal from the premises without refund.

6. BYOB Policy (Adults 21+)

If I choose to bring or consume alcoholic beverages on the premises:
– I certify that I am 21 years of age or older;
– I understand that I am solely responsible for my consumption and actions;
– I agree to drink responsibly and acknowledge that the Studio does not provide or serve alcohol;
– I understand that Crescent City Clayworks LLC may, at its discretion, call for assistance or request welfare checks if there are concerns about my safety;
– I acknowledge that Louisiana law prohibits operating a motor vehicle while impaired, and I accept full responsibility for transportation arrangements.

7. Legal Jurisdiction

This agreement is governed by and interpreted under the laws of the State of Louisiana.
If any portion of this agreement is found to be invalid, the remainder shall remain in full force and effect.

I further agree that if a lawsuit is filed against Crescent City Clayworks LLC or its representatives in violation of this agreement, I will pay all attorney’s fees and costs incurred by the Studio in defending such action.

8. Photography & Media Consent

I understand that the Studio may photograph or record classes and participants for marketing, promotional, or educational purposes (including social media, websites, and print materials).
If I wish to opt out, I must notify a staff member in writing prior to the start of class.

This applies to all individuals included under a group registration.

9. Email Communications

By providing my email at registration, I consent to receive periodic updates and communications from Crescent City Clayworks LLC, with the option to unsubscribe at any time.

10. Acknowledgment

By registering for or attending any Studio activity, I acknowledge that I have read this waiver in its entirety, understand its terms, and agree to be bound by it.
